1. Introduction
This Policy outlines the standards and practices required for all users of Safepay Services and specifies the types of activities and businesses that are prohibited. By accessing or using Safepay, you agree to comply with the terms and conditions of this Policy.
For avoidance of doubt, it is clarified that the list of businesses, activities, products, and industries mentioned below are not exhaustive. Terms that are capitalized in this Policy have the meaning provided to them in the Definitions section of the Services Agreement accessible here.
2. Prohibited Businesses
Safepay Services cannot be used for the activities or business types listed below.
2.1. Illegal and Unlawful Activities
- Any activities deemed illegal/unlawful by any governmental or regulatory authority in Pakistan or not permitted under the laws of Pakistan.
- Fraudulent activities, money laundering, or financing of terrorism.
- Sale or purchase of stolen property, burglary tools, or items obtained through illegal means.
- Telecommunications manipulation equipment including jamming devices
- Businesses that engage in, encourage, promote or celebrate unlawful violence or physical harm to persons or property.
2.2. Health & Safety, Drugs, Narcotics and Dangerous Substances
- Transactions involving recalled items that are banned from sale due to health or safety concerns.
- Sale of blood, bodily fluids, or body parts.
- Pseudo pharmaceuticals or nutraceuticals focused on significant weight loss or sexual performance or making any unsupportable or harmful claims
- Sale and distribution of banned narcotics, steroids, controlled substances, or any other products that pose a risk to consumer safety.
- Sales involving illegal drugs and drug paraphernalia, including but not limited to cannabis and related accessories.
- Equipment and items intended to be used for making or using drug
- Transactions related to chemicals that are regulated or prohibited by law.
2.3. Weapons, Explosives, and Firearms
- Sale of firearms, firearm parts or accessories, ammunition, weapons, or knives.
- Explosives, including fireworks, destructive devices, and other hazardous materials.
2.4. High-Risk Financial Services and Securities
- Unlicensed financial services, including currency exchanges, sales of currency without a license, and unauthorized cryptocurrency operators.
- Forex trading, binary options, and other unregulated investment schemes.
- Sale or purchase of stocks or securities without the necessary licensing.
2.5. Adult Content and Services
- Pornography, obscene material, or other adult content including literature, imagery and other media.
- Provision of certain sexually oriented materials or services including escort services, adult chat, and entertainment.
- Any artificial-intelligence-generated content that meets the above criteria.
2.6. Gambling and Betting
- Unlicensed or unauthorized gambling services, including but not limited to lottery tickets, sweepstakes entries, slot machines, and online betting platforms.
- Any online games, competitions or tournaments involving monetary prizes or fees.
2.7. Intellectual Property and Counterfeiting
- Sale of counterfeit items, including pirated software, fake goods, and any other products that infringe on intellectual property rights of any third party.
- Illegally imported or exported products
- Unauthorized sale of brand name or designer products or services
- Any other activities that violate copyright, trademarks, or other proprietary rights, including sales of items that infringe on the right of privacy or publicity in any jurisdiction.
2.8. Personal Data and Government Documents
- Sales or purchases of identity documents, government-issued documents, personal financial records, or other forms of personal information, such as mailing lists or credit card data, without proper authorization.
- Transactions involving police/ military badges, uniforms, or other official symbols.
2.9. Offensive Material and Hate Speech
- Sale or promotion of offensive material or content that encourages hate speech, violence, or racial intolerance.
- Items that promote the financial exploitation of a crime, or glorify illegal activities.
- Businesses that engage in, encourage, promote or celebrate unlawful violence toward any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic
2.10. Others Prohibited Items and Activities
- File sharing services or cyberlockers.
- Sale of items that are restricted or banned by any governmental authority in Pakistan.
- Any other products or services that Safepay considers risky or inappropriate or leading to the possibility of any adverse liability for Safepay.
3. Restricted Use of Safepay Services
In addition to prohibiting specific business activities, the Safepay Services cannot be used for the following purposes:
3.1. Fraud and Deception
- Engaging in fraudulent activities, including attempts to deceive customers, financial institutions, or regulators.
- Use of Safepay Services to create or operate Ponzi schemes, pyramid schemes, or other forms of deceptive multi-level marketing.
3.2. Abuse of Service
- Any action that could disrupt, interfere with, or degrade the operation of Safepay Services, including unauthorized access to the payment gateway, tampering with security features, or attempts to overload the system.
- Use of Safepay Services to facilitate or participate in activities that may cause damage or harm to the reputation of Safepay, its Acquiring Bank or a Network or other partners or users.
3.3. Unauthorized Transactions
- Processing or facilitating unauthorized payments on behalf of others, including activities such as payment aggregation, money transmission without appropriate licensing, or using the service to move funds on behalf of other individuals or entities without authorization.
- Engaging in transactions without the proper consent of involved parties, such as charging a customer’s payment method without proper authorization.
3.4. Money Laundering and Terrorism Financing
- Using the payment gateway for money laundering, hiding the origin of funds, or facilitating illegal financial transactions.
- Processing payments related to terrorism financing, criminal syndicates, or other illegal organizations.
3.5. Circumvention of Controls
- Attempts to bypass legal, regulatory, or internal controls, including falsifying or omitting information required by applicable laws of Pakistan or by Safepay’s due diligence procedures.
- Engaging in activities aimed at avoiding restrictions on the types of transactions or businesses prohibited under this policy or any applicable law of Pakistan.
3.6. Violation of Laws and Regulations
- Any activity which violates any rule or regulation of our Acquiring Bank or a Network;
- Use of Safepay Services to conduct activities that violate local, national, or international laws, including but not limited to financial crimes, bribery, corruption, or evasion of sanctions.
- Transactions intended to circumvent the laws and regulations of Pakistan, such as restrictions on cross-border payments, foreign exchange controls, or tax evasion.
3.7. Data Privacy Violations
- Collecting, processing, or distributing personal information in violation of data protection laws, including processing payments using stolen or unauthorized credit card information.
- Engaging in activities that could compromise the privacy or security of customer data, including unauthorized sharing or selling of customer information.
3.8. Offensive and Abusive Behavior
- Any activity which causes or threatens reputational damage to Safepay, our Acquiring Bank or any Network;
- Use of the Safepay Services to engage in harassment, abuse, or intimidation of others, including activities that promote violence or threaten the safety of individuals or groups.
- Conducting transactions or using our services to promote discriminatory practices, including but not limited to racial, religious, or gender-based discrimination.
4. Consequences of violation
If, in our sole discretion, we believe that you are in violation of this Acceptable Use Policy, we may (with or without notice to you) take such actions as we deem appropriate to mitigate risk to Safepay and any impacted third parties and to ensure compliance with this Acceptable Use Policy. Such actions may include, without limitation:
- Blocking the settlement or completion of one or more payments as permitted under our Services Agreement;
- Suspending your Safepay Accounts in accordance with the provisions of our Services Agreement;
- Terminating your Safepay Accounts pursuant to our rights under Services Agreement;
- Initiating legal proceedings against you for breach;
- Disclosing information related to such violations to the following parties, as deemed necessary: (i) individuals or entities who have engaged in transactions with you, including the sale or purchase of goods or services; (ii) any financial institutions, banks, or Networks associated with your business or transactions; (iii) Law enforcement or regulatory bodies; and (iv) any other third parties who may have been affected by such violations;
- Imposing any fees, penalties, assessments, or costs, including reasonable attorney's fees, incurred by us as a result of such violations, which you agree to promptly pay upon receiving notice.
5. Updates to this Policy
We may need to update, modify or amend this Policy. We reserve the right to make changes to this Policy by giving Notice in accordance with our Services Agreement.
